Pool Maintenance & Service Agreement: Peak Season Premium Maintenance

1. UNIVERSAL SERVICE STANDARDS & CHEMICAL POLICY: All water chemistry is tested and balanced to Certified Pool Operator (CPO®) professional standards. Standard baseline sanitizing and balancing chemicals (including standard liquid chlorine, chlorine tabs, muriatic acid, and sodium bicarbonate/soda ash) are fully included in your flat-rate service billing. However, specialized, heavy curative, or preventative treatment chemicals are not covered under standard maintenance and will be billed as used based on pool demands. These specialty items include, but are not limited to: Commercial Algaecides, Phosphate Removers, Metal Sequestering Agents, Stain Preventatives, Specialized Clarifiers, Flocculants, and Cyanuric Acid (Stabilizer) bulk re-balancing.
2. BILLING & ACCESS: Flat seasonal fees are automatically billed as a recurring payment on the 1st of each month during the active service period. Client agrees to provide clear, unobstructed access to the pool and all filtration/pumping equipment. All pets must be secured away from the service area on scheduled days. Client is responsible for maintaining the pool water at the mid-tile line between visits.
3. EXCESSIVE DEBRIS & DISPOSAL: Standard maintenance includes up to 15 minutes of skimming/debris removal. If a visit requires additional time due to storms, heavy leaf fall, or neglected landscaping, an Excessive Debris Fee of $50 per half-hour will be applied. All debris will be placed in onsite receptacles; offsite hauling is not included.
4. SERVICE-SPECIFIC TERMS — EXTENDED PEAK SEASON MAINTENANCE: Weekly maintenance visits are strictly performed throughout the extended 6-to-7-month swimming season, **beginning April 1st and concluding October 31st**. Each service run includes a complete surface skimming, pool wall/step brushing, and full pump/skimmer basket clearing.
5. MANDATORY OPENING & CLOSING FEES: The flat recurring monthly maintenance rate covers routine weekly care only. **Pool Opening services (Spring) and Pool Closing/Winterization services (Fall) are entirely separate, specialized service lines and carry mandatory separate charges.** These technical operations are billed independently of the monthly subscription based on equipment layout, pool size, and cover requirements. Opening fees will be billed at the initiation of the season, and Closing fees will be billed upon completion of winterization layout execution in October.
6. 🔄 RECURRING PAYMENT SCHEDULE & RATE LOCK: By selecting this plan, the client authorizes Newshades PWS to establish an automatic, recurring monthly billing cycle through GoDaddy Payments covering the active 6-to-7-month season window (April – October). Your specific monthly rate is **guaranteed and locked for a period of twelve (12) months** from initial authorization to protect against in-season chemical market surcharges. This recurring subscription automatically pauses for the winter on October 31st and will auto-resume the following April at renewal. Newshades PWS reserves the right to evaluate and adjust recurring rates by up to 5% at the annual renewal mark to match local overhead inflation, providing a 30-day written notice.
7. 📅 ROUTING & SCHEDULING NOTICE: We utilize advanced routing optimization profiles for all pool cleaning lines. You will be explicitly notified of the specific day of the week our trucks will visit your property. However, due to daily seasonal workloads, weather disruptions, truck positioning, and field dynamics, we cannot guarantee or set a specific, fixed arrival time window for your service day.
8. LIABILITY WAIVER: Newshades PWS is not responsible for pre-existing equipment failure, underground leaks, structural deterioration, or “Acts of God” (storms/flooding). Client assumes all risk for pool use by household members and guests.
